1. Introduction

Meanwhile Education Pty Ltd which trades as Matilda Education ("Matilda Education", "we", "our" or "us") is committed to protecting the privacy of users of the MyDigital platform.

This Privacy Policy explains how we collect, use, disclose, store and manage personal information when individuals access or use MyDigital.

MyDigital is an online learning platform that provides access to digital textbooks and related educational resources for teachers and students.

Age Requirements and Consent

MyDigital is intended for use by teachers and students. Users under the age of 18 may only use MyDigital with the consent of a parent, guardian, school or other authorised educational institution. By creating an account, users confirm that they have the authority to accept this Privacy Policy or have obtained the necessary consent from a parent, guardian or authorised educational institution.

Users must acknowledge and accept the Privacy Policy and Terms and Conditions as part of the account registration process before access to MyDigital is granted. Where the Privacy Policy or Terms and Conditions are updated, users are required to review and explicitly accept the latest versions before continuing to use MyDigital. 

Account Information

Users must provide complete, current and accurate information when creating and maintaining a MyDigital account. Users must not create accounts using false identities, misleading information, pseudonyms or another person's details without appropriate authorisation.

Users are responsible for ensuring that their account information remains accurate and up to date. Matilda Education may suspend, restrict or remove accounts where inaccurate, misleading or unauthorised information has been provided.

2. Personal Information We Collect

The personal information we collect may include:
• First name and last name
• Email address
• School or educational institution
• User account and login information
• User-generated content such as notes, annotations and voice recordings
• Technical information such as IP address, browser type, device information and platform usage data
• Communications with Matilda Education support services

3. How We Collect Personal Information

We collect personal information directly from users when they register an account, redeem access codes, interact with customer support, or use the platform.

4. Why We Collect Personal Information

We collect, use and hold personal information to:

• Create and manage user accounts
• Provide access to MyDigital content and services
• Authenticate users
• Deliver educational content and platform functionality
• Provide customer support
• Maintain platform security and integrity
• Investigate technical, security or misuse incidents
• Meet legal, regulatory and contractual obligations
• Improve the operation and performance of the platform
• Notify users about new content, product updates, service announcements, account-related matters and other information relevant to their use of MyDigital

5. Disclosure of Personal Information

Personal information may be disclosed to schools, authorised personnel, service providers supporting MyDigital, hosting providers and regulators where required by law. We do not sell personal information.

MyDigital uses a limited number of third-party service providers (sub-processors) to provide hosting, platform support, maintenance, security, analytics and related services. Details of these sub-processors, including the information they may process, the purpose of processing and the locations in which information may be processed or stored, are set out in the MyDigital Sub-processors section of this Privacy Policy.

6. Consequences of Not Providing Information

If required information is not provided, we may be unable to create an account, provide access to MyDigital or deliver services.

Users who do not accept the current Privacy Policy and Terms and Conditions, or where required consent has not been obtained, cannot register for or continue to access MyDigital.

7. Access and Correction

Individuals may request access to personal information held about them and request correction of inaccurate or incomplete information.

8. Data Security

MyDigital is hosted on secure cloud infrastructure located in Australia. Appropriate administrative, technical and physical safeguards are implemented to protect personal information.

9. Overseas Disclosure

MyDigital customer data is hosted in Australia using cloud infrastructure located in Australia.

Matilda Education does not routinely transfer or store customer data outside Australia. However, authorised personnel employed by Matilda Education's technology and support partner, Excelsoft Technologies, may access customer information from India when providing application development, maintenance, technical support, incident investigation or platform administration services.

Where such access occurs, it is subject to contractual confidentiality obligations, information security controls, access restrictions and privacy protections designed to safeguard personal information.

Accordingly, personal information collected through MyDigital may be processed or accessible from Australia, India and other countries in which our disclosed sub-processors operate. Further details are provided in the MyDigital Sub-processors section of this Privacy Policy. 

Matilda Education takes reasonable steps to ensure that any overseas access to personal information is handled in a manner consistent with applicable Australian privacy requirements and contractual obligations.

10. Account Retention, Inactive Accounts and Data Deletion

Matilda Education maintains account lifecycle and data retention processes to ensure personal information is not retained longer than necessary.

User accounts may be identified as inactive or dormant where there is no longer an active subscription or educational requirement for access to MyDigital.

Where a subscription ends and is not renewed, associated user accounts and personal information may be scheduled for deletion. Prior to deletion, reasonable efforts will be made to notify affected users and/or the relevant educational institution that data is due to be removed.

Personal information and user-generated content associated with expired subscriptions are generally removed from active systems 90 days after the subscription ends, unless retention is required for legal, regulatory or contractual purposes.

Copies of information contained within backup systems may remain until the applicable backup retention period expires, after which they are securely deleted or overwritten.

11. Complaints

Individuals who believe their privacy has been breached may submit a complaint to Matilda Education at the email address shown below. Complaints will be investigated and responded to within a reasonable timeframe.

If an individual is not satisfied with Matilda Education's response, they may contact the Office of the Australian Information Commissioner (OAIC).

13. Changes to this Policy

Matilda Education may update this Privacy Policy from time to time. The current version will always be made available through the MyDigital platform.

When this Privacy Policy is updated, users will be presented with the latest version and required to explicitly accept it before continuing to use MyDigital. 

14. MyDigital Sub-processors

Matilda Education uses the following third-party service providers to operate, host, maintain, secure and support the MyDigital platform.

These providers may process personal information only for the purposes described below and subject to applicable contractual, privacy, confidentiality and information security requirements.

Amazon Web Services, Inc. (AWS)

Cloud infrastructure, hosting, data storage, backup, system availability, security, monitoring and related infrastructure services.

MyDigital customer data stored within the platform, including user account information, educational content, user-generated content, platform activity records, device metadata, system logs and backups.

Google LLC — Firebase Crashlytics, Google Analytics

Mobile application crash reporting, diagnostics, stability monitoring and technical troubleshooting for the MyDigital Library application. Analyze website traffic and usage statistics 

Randomised application or device identifiers, application version, device and operating-system information, crash logs, diagnostic information and technical data associated with an application failure.

Global – Google may process and store information in countries where Google or its agents maintain facilities. Firebase Crashlytics operates on Google's global infrastructure. Google Analytics uses regional data collection centers and Google's global processing infrastructure.

Necessary to monitor application performance, diagnose faults, maintain application stability and secure the service.

Additional service providers

Matilda Education periodically reviews the third-party providers used in connection with MyDigital. The list will be updated where a new provider is engaged to process personal information or an existing provider’s purpose, information types or processing location changes.

Some third-party integrations, such as digital resellers, learning-management systems and linked educational content providers, may operate independently rather than as sub-processors acting solely on Matilda Education’s instructions. These services are addressed separately in Matilda Education’s Privacy Policy, Terms of Service and relevant contractual arrangements.
